WAIVER: Permission is hereby given for the above-named child to participate in RMS FBLA Business Club activities, competitions, off-campus activities, outreach events, and field trips. As the parent or guardian of the above-named child, I, for myself, my heirs, personal representatives or assigns, do hereby release, waive discharge, and covenant not to sue Saratoga Union School District, Redwood Middle School, RMS FBLA Business Club, their teachers, off-campus field host, members and volunteers (hereinafter collectively, “releases”) from liability from any and all claims including negligence of releases resulting in personal injury, accidents or illnesses (including death) and property loss arising from, but not limited to, participation in activities, competitions, field trips, and use of facilities, premises, or equipment.
ASSUMPTION OF RISKS: My child will be participating in RMS FBLA Business club activities, competitions and field trips. I recognize that there are risks involved in participating in these activities, competitions and field trips and hereby assume all risk of injury, harm, damage, or death in connection with his/her participation in these activities, competitions and field trips.
MEDICAL AUTHORIZATION RELEASE: I hereby consent for my child to receive medical treatment, which may be deemed advisable in the event of injury, accident and/or illness during the program. If a serious accident or medical emergency does occur, 911 will be called and the parents/guardian will be called next. It is understood that the resulting expenses will be the responsibility of the undersigned. The undersigned does also hereby give permission for our (my) child to ride in any vehicle designated by the adult in whose care the child has been entrusted in the event of a medical emergency requiring transportation to a medical facility.
INDEMNIFICATION AND HOLD HARMLESS: I also agree to INDEMNIFY AND HOLD releases HARMLESS from any and all claims, actions, suits, procedures, costs, expenses, damages and liabilities, including attorney’s fees brought as a result of my child’s involvement at RMS Robotics Club and to reimburse them for any such expenses incurred.
SEVERABILITY: The undersigned further expressly agrees that the foregoing waiver and assumption of risks agreement is intended to be as broad and inclusive as is permitted by the law of the State of California and that if any portion thereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect.
ACKNOWLEDGEMENT OF UNDERSTANDING: I have read this waiver of liability, assumption of risk, and indemnity agreement, fully understand its terms, and understand that I am giving up substantial rights, including my right to sue. I acknowledge that I am signing the agreement freely and voluntarily, and intend by my signature to be a complete and unconditional release of liability to the greatest extent allowed by law.
